The attorneys of the firm have extensive experience with alternative dispute resolution (ADR) methods. In particular, arbitration, and with mediation.

The firm’s attorneys have been involved as counsel to parties in arbitrations before the American Arbitration Association (AAA), non-binding arbitration proceedings in circuit court, and State of Florida Attorney General arbitrations. The AAA arbitrations have been before the general dispute division as well as the Commercial and International divisions. In addition, both Eric Assouline and Peter Berlowe are Florida Supreme Court Qualified Arbitrators and Mr. Assouline has been appointed to act as arbitrator to a number of arbitrations by different judges in Broward County. Mr. Assouline has also served as arbitrator to a number of Better Business Bureau Autoline Lemon Law program.

Since most Broward and most Miami-Dade circuit court and county court cases are referred to mediation before going to trial, all of the firm’s senior attorneys have had extensive experience with dozens of pretrial mediations. This process is an integral part of any court proceeding because it gives the parties an opportunity to explore settlement possibilities before a disinterested mediator. Many of the firm’s clients’ disputes have been resolved at mediation, which is often very beneficial for the clients because it eliminates the risk of an unfavorable result at trial or through summary judgment, and at the same time ends the often unpleasant experience of costly and protracted litigation.
