Assouline & Berlowe procured a judgment for over three million dollars ($3,000,000.00) including prejudgment interest against a copyright infringer that posted a client's copy protected video on Youtube.com.
Assouline & Berlowe procured a judgment for two million eight hundred fifty thousand dollars ($2,850,000.00) plus interest against a copyright and trademark infringer that unlawfully used a clients copyright works on an unauthorized website.

Eric N. Assouline, Esq. was inducted to the Board of Directors for B’nai B’rith Justice Unit #5207, at the organization's Twenty-Eighth Annual Installation Brunch. The B’nai B’rith Justice Unit members consist of Jewish attorneys and judges, located primarily Broward County, Florida. The Justice Unit has provides an important avenue for civic and social involvement of its members. It sponsors social, educational and charitable programs for its members in conjunction with other Broward County voluntary bar associations and professional organizations.

Koziol, Esq. and Lorri Lomnitzer, Esq. were invited to speak at the Florida Entertainment and Sport Law (EASL) 2008 RETREAT LECTURE SERIES, How to Advise Your Clients in Your Practice of Law in the Digital Age regarding Intellectual Property Rights Protection and Infringement in the New Digital Era. Both, Ms. Lomnitzer and Mr. Koziol, will be discussing the legal and ethical issues faced by the practitioner in advising the client in the era of downloading, streaming and copying on the Internet and new technologies, including copyright infringement and protection of intellectual property on the web, so the client is protected on sites such as at My Space, Facebook, YouTube, and iTunes. Emphasis will be on development of intellectual property and information technology. Other topics covered will be safeguards that can be put into contracts for web-streaming and the other interactive multimedia devices connecting retailers to customers in the areas of music, entertainment, publishing and the world of fashion. Business, transactional and technology safeguards will be covered as well as counterfeit goods, fraud, domain names and tech crimes.

Assouline & Berlowe obtains a judgment for $732,315.84 for a client on a $175,000.00 worthless check. After a hearing, the court determined that the Defendant had the intent necessary for awarding actual damages plus statutory treble damages, interest and attorneys' fees. The firm also procured a judgment for the client in this case for $246,128.74 for the Defendants' breach of a $200,000.00 promissory note.

Assouline & Berlowe can now process electronic copyright registrations. Peter A. Koziol, Esq. was one of the limited number of participants selected by the United States copyright office to beta test its new electronic copyright registration system. The system is expected to enable faster copyright application processing times, earlier effective dates of registration, better status tracking and lower fees.

U.S. Bankruptcy Court grants Eric N. Assouline, Esq.'s motion to dismiss Chapter 11 petition for bad faith. Eric N. Assouline successfully argued, in the United States Bankruptcy Court for the Southern District of Florida, that a Chapter 11 bankruptcy petition for a single asset real estate debtor should be dismissed as a "bad faith filing" with prejudice for 1 year. At the hearing, the Court, after hearing testimony from witnesses and arguments of counsel, found that all the factors under the landmark case of In re Phoenix Picadilly, Ltd., 849 F.2d 1393 (11th Cir. 1988) were established. The dismissal of the bankruptcy allowed the client to return to state court to reset auction of its secured collateral, as had been attempted previously until the defendant filed for bankruptcy within hours of the prior foreclosure sale. Sheri M. Alter, Esq. successfully defends retail center owners on multiple ADA claims. Ms. Alter defended a client in two companion Americans with Disabilities Act cases filed in U.S. District Court, against two separate retail center owners, wherein the plaintiffs sought injunctive relief and attorneys' fees for alleged ADA violations. Through Ms. Alter's efforts, the plaintiffs were forced to voluntarily dismiss both cases with prejudice and the client did not have to pay any attorneys' fees to the plaintiffs. Eric N. Assouline, Esq., on Friday February 9, 2007, obtained two separate judgments, for two separate clients, in separate cases, totaling almost $1 Million. In one case, Mr. Assouline, on behalf of the client, a subsidiary of a U.S. Fortune 50 company selling cosmetics internationally, obtained a federal court judgment for more than $770,000 against a California defendant. On the same day, in a case against the seller of real property, Mr. Assouline obtained a Broward County Circuit Court judgment against a New York defendant, where the Court found in favor of the client, the buyer, and, after taking fact and expert witness testimony, held that the defendant was liable to the client for more than $210,000 in lost benefit of bargain damages.
