Real Estate & Construction Litigation | |
The attorneys in the firm have represented clients in a wide variety of real estate related transactional and litigation matters.
For example, the Firm's attorneys have represented borrowers and lenders in both commercial and residential foreclosures. The Firm has also been involved in the drafting of residential and commercial leases, as well as litigating landlord-tenant disputes, representing both lessees and lessors. The firm's attorneys have also litigated specific performance real estate cases as well as cases where the parties seek partition of the property.
Attorneys of the firm have also been involved in several American with Disabilities Act ("ADA") disputes representing landlords and tenants that are sued for ADA compliance issues. These cases are litigated exclusively in federal court and require skilled litigators to balance the need for proper enforcement of the law without abusing the time, effort and expense involved by counsel to assure the property conforms with law.
Construction Law and Litigation
The Firm's attorneys have represented owners, lenders, builders, and contractors in both construction contracting and construction litigation. Mr. Berlowe in particular is well versed in the construction lien laws (also known as "mechanic's laws") under Florida Statute Chapter 713, and counsels his clients accordingly. His experience as an engineer, prior to becoming an attorney, allows him to analyze construction cases from a scientific and economic standpoint, as well as a legal standpoint.
Title Insurance
The attorneys of the Firm are authorized to write title insurance policies for National Tile Insurance and The Fund.
